Real Estate Law

Real estate transactions are generally called “Closings.”
We prefer to think of them as “Openings".

Your home is a hugely important aspect of your life. Our goal is to make the purchase or sale of the home a smooth, memorable, and enjoyable experience. Every closing is an opening to a new chapter in your life.

Buyers

As counsel representing a Buyer in a real estate transaction, we will do the following to ensure a smooth closing process:

 

  • Review Offer to Purchase

  • Review the Purchase & Sale Agreement

  • Negotiate the Purchase & Sale Agreement and review with client(s)

  • Refer to home inspectors, mortgage lenders and other professionals, if necessary

  • Communicate any issues arising between signing of the Purchase & Sale Agreement and Closing

  • Review Title Examination and prepare Attorney Title Certification

  • Obtain and review Municipal Lien Certificate from Town

  • Obtain and review mortgage and lien payoff information

  • Preparation of Loan Documentation, if any 

  • Review Deed and other Seller Documentation

  • Obtain and agree upon closing costs and adjustments 

  • Coordinate closing

  • Obtain and disburse closing funds 

  • Attend closing and review, interpret and explain all closing documentation

  • Record Closing Documents at the Barnstable County Registry of Deeds

  • Preparation and issuance of the Title Insurance Policy

  • Review Condominium Documents and prepare condominium synopsis (if applicable)

Sellers

As counsel representing a Seller in a real estate transaction, we will do the following to ensure a smooth closing process:

 

  • Review Offer to Purchase

  • Draft the Purchase & Sale Agreement

  • Negotiate the Purchase & Sale Agreement and review with client(s)

  • Review Seller responsibilities for closing

  • Communicate any issues arising between signing of the Purchase & Sale Agreement and Closing

  • Address any title issues 

  • Obtain mortgage and lien payoffs

  • Prepare Deed and other Seller Documentation

  • Obtain and agree upon closing costs and adjustments 

  • Attend closing and review, interpret and explain all closing documentation
